All the terms of service of the Shop Conservaspinhais.com will be done by the Timeless Tin SL. Please see below all the terms of service.
1. IDENTIFICATION OF THE PARTIES
The parties involved in this contract are:
On one side, The Timeless Tin S.L. with CIF B56796253 and registered office at Avenida Erdoza 36, Markina-Xemein 48270 Bizkaia (hereinafter The Timeless Tin), which is the owner of the online electronic commerce hosted at https://thetimelesstin.com/ (hereinafter the Website).
On the other side, the “User/Buyer” understood as any adult who accesses the Website https://thetimelesstin.com/ and completes all steps towards the purchase of products freely and voluntarily, including acceptance of these General Contracting Conditions.
The Timeless Tin S.L. provides the contact email address support@thetimelesstin.com for possible claims or queries. You can also contact us through the phone number (+34) 681 392 306. The sale of alcoholic products to minors under 18 is not allowed, so prior registration of buyers is required to verify their age as well as a confirmation or responsible declaration at the time of purchase that they are of legal age.
2. OBJECT
The purpose of these General Purchase Conditions is to regulate the acquisition by the Registered User of products through the Website in exchange for an economic consideration as stipulated herein.
3. PRODUCTS
3.1. Product Offer
The Website provides information about all products for sale, including characteristics and prices.
However, it reserves the right to withdraw, replace, or change the products offered to its customers through its website by changing the content of the same.
The products offered at any given time on the Website will be governed by the general conditions in force at each moment, so the company will have the authority to stop offering access to the mentioned products without prior notice and at any time.
3.2. Availability
The availability of our products may vary depending on customer demand. Our stock is updated periodically, but we cannot guarantee that the product you select will not be out of stock.
If the user has made a purchase and the product is out of stock, they will be informed immediately, and a refund will be processed through the same method used for payment.
4. DESCRIPTION OF THE PURCHASE PROCESS
The purchase process can be carried out through the Website by identifying as a Registered User. To purchase the products available in the catalog, the User must click on those of interest, selecting the “Add to cart” option. The selected products will automatically be available to the User in the shopping cart.
Next, the User must:
a) Once the User has verified that the products in the cart match the selection made, they can proceed to place the order.
b) Once the product is added to the cart, a summary of its contents with the breakdown of price and shipping will be displayed. The “Complete purchase” option must be selected.
c) The purchase process will be displayed on the screen with a form to enter contact and shipping information and the corresponding consideration indicated in the form at each moment.
d) In the case of selling alcoholic products, it will be verified that the buyer is of legal age unless already registered on the Website.
e) The Buyer must select the chosen payment method. Currently, the available payment methods are:
a. Debit or credit card: In this case, we will need you to provide information about your card solely for processing the payment.
b. Apple Pay: In this case, the User will need to enter their account details to access it and process the payment.
c. Google Pay: In this case, the User will need to enter their account details to access it and process the payment.
f) Once the User has provided this information, they must proceed to payment and thereby confirm their intention to acquire and formalize the purchase, after accepting these Conditions.
g) If The Timeless Tin accepts the order, it will confirm having received the Buyer's purchase intention and, where appropriate, the order payment. Likewise, the corresponding invoice for the purchase will be made available to the Buyer through the following system: the order confirmation is sent by email, and the delivery note is sent with the delivery. By accepting these Conditions, the Buyer allows the sending of an electronic invoice. At any time, they can oppose this by indicating it to the email support@thetimelesstin.com.
h) Once the order is confirmed, the Buyer will receive the products within the period indicated on the Website. If The Timeless Tin does not accept the order, the payment will not be processed, and the reasons will be notified by contacting the user.
I) To receive a VAT-exempt invoice, all valid VAT information must be provided during the checkout process before the order is finalized. We are unable to modify, reissue, or retroactively apply VAT details to an invoice once an order has been processed.
J) Shipping addresses must be entered using standard Latin characters and numeric formats only. Please do not use Roman numerals or special numbering systems in address fields, as this may cause processing or delivery issues. In the event that an order cannot be delivered due to incorrectly formatted address information provided by the customer, the customer will be responsible for any additional shipping costs required for reshipment.
K) Please note that our logistics provider is unable to deliver to PO boxes addresses. Customers are required to provide a valid physical shipping address to ensure successful delivery.
In the event that a PO box address is provided and the order cannot be delivered as a result, the customer will be responsible for any additional shipping costs incurred for reshipment to an alternative valid address.
5. PRICING POLICY
The prices displayed on the Website are set by The Timeless Tin. Prices are shown in Euros.
Before purchasing any selected products, we will show you the prices broken down according to the base price and applicable taxes at each moment.
The prices of the products displayed on the Website may be modified without prior notice to the User, as long as the purchase process has not started, in which case the prices will not be modified. All amounts will be shown broken down during the purchase process and before proceeding to payment. If you cancel a product during a purchase process and select it again, the price of the product will be the one indicated at that second moment.
Additionally, according to the regulations on product prices offered to consumers and users, we offer the price per unit of measurement on all products that must indicate the quantity to which they refer (liters, kilos, etc.), as well as products marketed by units or pieces, using one as the unit reference. The final price of certain fresh or bulk products may vary slightly from the initially indicated price in the purchase process, as it depends on the exact weight at the time of preparation before shipping. For example, when buying a kilo of apples at 1 euro per kilo, although the initial order shows 2 euros for the purchase of 2 kilos, if the exact weight is 2.15 kilos, the final price will be 2.15 euros.
The prices do not include certain applicable taxes that must be paid by the Customer for shipping reasons. The Timeless Tin cannot determine the applicable taxes in advance as it will depend on the location from which the order is placed. Once the Customer has entered this information in the appropriate form, the information related to the taxes to be paid will be displayed to the Customer.
The transportation and delivery costs of the products will be indicated on the Website at each moment and in the Shipping and Returns Policy.
6. DISCOUNT POLICY
Discount coupons held by the Consumer can be applied at the time of purchase. The discount methodology by coupons is as follows:
- Personalized for a group of customers, the coupon is received via email or instant messaging systems, and the customer will have a specified period to use it. This period is indicated in the personalized discount sent by instant messaging systems; after this period without making any purchase, the customer loses the right to the discount.
- There will be a 10% welcome discount on the first purchase. Any modification to the discount policy is subject to the will of The Timeless Tin.
7. ACCEPTANCE OF GENERAL PURCHASE CONDITIONS
When the purchase is made entirely through the Website, you must read these Conditions and expressly accept them by clicking on the corresponding consent verification box, which is unchecked by default at the end of the purchase process.
If there are special rules or restrictions affecting certain rates, discounts, and/or selected products, such special rules or restrictions will be presented to you on the screen before proceeding with the product purchase.
8. OBLIGATIONS OF THE PARTIES
8.1. Obligations of THE TIMELESS TIN
The Timeless Tin undertakes to:
a) Efficiently carry out all procedures aimed at the execution of the receipt by the Buyer of the purchased products.
b) Send the Buyer all necessary information and documentation for order receipt.
c) Not allow any transaction that is illegal or considered by credit card brands or the acquiring bank to potentially damage their goodwill or negatively influence them. Under the card brand programs, the following activities are prohibited: the sale or offering of a product or service that is not fully compliant with all applicable laws to the buyer, issuing bank, merchant, cardholder, or cards; as well as the sale of medications.
d) Establish the full name of the food.
e) Include the list and quantity of ingredients.
f) Include information on allergens as well as any ingredient from which a substance or product causing or potentially causing intolerances or allergies is derived and used in the preparation of a food, and which remains present when the product is finished even in a modified form.
g) Include the net quantity of the food, the minimum duration date, or, where appropriate, the expiration date.
h) Include special storage conditions and/or conditions of use.
i) Include the name or business name and address of the Operator of the business.
j) Include the country of origin of the food products.
k) Indicate the nutritional information of the product.
l) Add a usage method for the appropriate use of the food.
m) Establish the alcoholic strength in beverages with a volume greater than 12 percent.
n) Comply with these obligations as well as any other applicable obligations.
8.2. Obligations of the Buyer
By accepting these Conditions, the Buyer agrees to:
a) Pay the corresponding amounts specified in the purchase process in a timely manner. Failure to pay will exempt The Timeless Tin from fulfilling the obligations stated here and any other obligations contracted in exchange for receiving economic consideration for the products.
b) Be responsible for the veracity and authenticity of any data provided to make the purchase of selected items.
c) Assume the responsibilities derived from any act carried out with their User ID.
d) Fulfill any other obligations established in these General Conditions.
9. DISCLAIMER
The Timeless Tin shall in no event be liable for damages caused to the Buyer attributable to the Buyer itself. Solely and exclusively, The Timeless Tin shall be responsible for damages resulting from purchases made on the Website, provided that they arise from intentional or negligent actions on its part. For illustrative purposes only, The Timeless Tin is not responsible for:
a) The utility that the products acquired by the Buyer may have, since at no time is The Timeless Tin responsible for the selection made, even if it identifies items in combination with the selected products that are recommended as accessories and/or complements.
b) Personal or material damages caused as a result of the use of the products, provided that the specified recommendations therein have not been followed.
c) Failure to fulfill its obligations due to force majeure such as, without limitation, internal or external strikes, natural disasters, social unrest, etc.
The Buyer thus acknowledges that they acquire the items at their own risk and peril, with The Timeless Tin's activity limited to the execution of the material tasks necessary for delivery, processing, and management.
In any case, The Timeless Tin's liability to the Buyer shall never include loss of profit and shall be limited, at most and for any reason, to the total amount received from the Buyer in consideration for the purchase of the product in accordance with these Conditions.
10. INDEMNIFICATION
Any type of damage, harm, loss, or cost (including attorney's fees and/or procurators) resulting from a breach by the Buyer of these Conditions or any other applicable ones, incurred by The Timeless Tin, shall be reimbursed by the Buyer who caused it. This includes any third-party claims arising from such breaches.
11. MODIFICATIONS
These Terms may be modified and/or updated at any time without prior notice. The modifications made shall become effective upon their publication on the Website, regardless of the means and form used for such publication.
The modification shall only affect Buyers who have accepted it after such modification
12. OTHER MATTERS
12.1. Safeguard and Interpretation of these Conditions
If a competent authority declares any of these provisions to be illegal, invalid, or unenforceable, it shall be interpreted as closely as possible to the original intention of such provision. In any case, such declaration regarding one or more clauses shall not affect the validity of the remaining ones.
The failure by The Timeless Tin to strictly enforce any of the terms of these Conditions does not constitute, nor shall it be construed in any way as, a waiver on its part to enforce it in the future.
12.2. Language
The language applicable to these Conditions is the Spanish translation. If versions in other languages are provided, it is solely for courtesy and for the Buyer's convenience. Therefore, the Buyer expressly agrees that they shall be governed by the Spanish version. In case of contradiction, the Spanish version shall prevail.
12.3. Legislation and Jurisdiction
The relationship between The Timeless Tin and the Buyer shall be governed by Spanish law, and any disputes or conflicts concerning these Conditions shall be submitted to the Courts and Tribunals of the Buyer's domicile, provided that they have the status of consumer and user in accordance with applicable regulations. Otherwise, the parties submit to the Courts and Tribunals of The Timeless Tin's domicile.
If the Buyer encounters any issues arising from the purchase of products available in the Website's Catalog, they may resort to the European Union's online dispute resolution system, accessible from the following link: https://webgate.ec.europa.eu/odr/main/?event=main.home.show&lng=ES.
13. SHIPPING AND RETURN POLICY
13.1. Shipping and Returns
13.1.1. Shipping Costs
The amount of these costs is determined by the transport company used by The Timeless Tin. They can be viewed at the time of payment processing, just before confirming the order. More Info on our Shipping Policy.
Shipments to the Canary Islands: Shipments to the Canary Islands are not made.
Shipments to Ceuta and Melilla: Shipments to Ceuta and Melilla are not made.
13.1.3. Order Tracking
At The Timeless Tin, we assign a tracking number to each order so that your order can be located at all times. You can track your order by contacting us at the email address support@thetimelesstin.com.
13.1.4. Delivery
All orders received before 10 A.M will be processed the same day. Handling time may take up to 3 business days. Delivery will take 2/3 days for Portugal, 7/15 days for European Union, 5 days for United States and 3/4 weeks for the rest of the countries.
Additionally, local, regional, and national holidays must be taken into account, as they are non-working days, which may extend the delivery times.
If any item(s) from your order are not available, The Timeless Tin will inform the Buyer of the new delivery time, indicating the possibility of a refund for the amounts paid for the specific item(s), or the substitution with a similar or superior quality product, at the Buyer's choice. In the latter case, the Buyer may exercise their rights of withdrawal and resolution in accordance with the terms applicable to the initially purchased item.
To optimize delivery, The Timeless Tin would appreciate it if the Buyer could provide an address where the order can be delivered during normal business hours.
The product upon delivery includes a delivery note in the shipping box.
The Timeless Tin only works with specialized courier and transport companies. In case of absence, the courier will make a second attempt to ensure delivery within the established timeframe. If not possible, the courier will contact the Buyer using the provided phone number.
Once your order has left The Timeless Tin's warehouses, it is in the hands of the transport company chosen by the Buyer. Therefore, The Timeless Tin does not control the order. If you have any doubts or inquiries and your package has already left our warehouses, please contact the chosen transport company directly.
The Buyer is responsible for the accuracy and correctness of their provided address details. In case of an error in the address (in whole or in part) resulting in a need for a second shipment, the Buyer will be responsible for the shipping cost incurred.
13.1.5. Warranty and Claims
All offered products are original brand products, with a factory warranty certificate and initially free of defects.
In case of any defect or lack of conformity, the consumer may choose between repair or replacement of the affected product, unless the latter is impossible or disproportionate.
For this purpose, the consumer has a period of two months from the date of knowledge of the non-conformity.
The Timeless Tin is liable for lack of conformity that manifests within two years from delivery. It is presumed that lack of conformity that manifests within six months of delivery already existed when the item was delivered; after six months, the consumer must prove that the lack of conformity existed at the time of delivery of the goods.
13.1.6. Defective Products or Incorrect Shipments
In the event that the product is returned due to lack of conformity (defective products or incorrect shipments), the user shall have the right to choose either a refund of the amount paid or the replacement of the product with another of identical characteristics. In such cases, The Timeless Tin will bear the shipping or return costs of the product.
However:
In the case of return due to an incorrect shipment, it will be necessary to return the product with the packaging in perfect condition, ensuring that the product and its accessories are in perfect condition, and that the product is packaged in a way that prevents damage during transport, with the user assuming any damages during the process. The Timeless Tin will not accept returns of products that have been unsealed or show signs of use.
In the case of a defective product, the user should attempt to return the product in the best condition possible.
If the merchandise is in good condition but for some reason the customer is not satisfied with their purchase, they have a period of 14 days from receipt to exercise their right to return it. The user may decide whether to exchange it for another product or request a refund. In this case, return shipping costs will be borne by the customer.
The refund will be made according to the form of payment initially made by the user, provided that the aforementioned requirements are met. The refund may be made by providing a discount voucher redeemable in the online store, at the Buyer's choice.
The return period will be established by current regulations.

13.2. Right of Withdrawal
13.2.1. General
In accordance with the law, the Buyer has a period of fourteen (14) days from the date of receipt of the products to exercise their right of withdrawal without having to justify the reasons or pay penalties, except for shipping costs, provided they are considered Consumers and Users.
All items must be returned in the same condition as they were delivered, with all their packaging and accessories, as long as this allows for all necessary checks and manipulations to determine the characteristics and functionalities of the products.
The Buyer shall be responsible for any decrease in the value of the items if they have carried out any manipulation other than that necessary to establish the characteristics and functioning of the purchased products.
The returned product must be accompanied by a photocopy of the delivery note.
Once we receive the merchandise in our warehouse, and after checking its condition, we will proceed to refund the amount according to the payment method made by the Buyer.
Return shipping costs will not be refunded under any circumstances.
The additional costs of return management will be borne by the user prior to the return, as long as it is returned by a means other than that indicated by THE TIMELESS TIN
The Buyer may also communicate their intention to withdraw from the contract to The Timeless Tin by using the following model:

13.2.2. 2.2. Exceptions to the Right of Withdrawal
However, in accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, the right of withdrawal cannot be exercised as it is stated that the right of withdrawal shall not apply to contracts that refer to:
a) Goods that can deteriorate or expire rapidly, such as most fresh foods.
b) Sealed goods that are not suitable for return for reasons of health protection or hygiene and have been unsealed after delivery. Such as most cleaning and personal care and cosmetic products.
c) Goods that, after delivery and considering their nature, have been mixed inseparably with other goods.
